This privacy notice explains how we use information in the course of our work as a local planning authority (LPA). We receive comments, allegations and questions from third parties via email, letter and through the Councils online platforms. If you submit a comment via the Councils website or email, you will receive an automatic response which is evidence of receipt. What we do with your information To allow us to make decisions on planning applications, individuals must provide us with some personal data (e.g. name, address, contact details). In a small number of circumstances individuals will also provide us with special category data in support of their application (e.g. evidence of medical history/ethnicity). We use the information provided to us to make decisions about the use of the land in the public interest. The lawful basis for this under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 (DPA) as a HYPERLINK "https://ico.org.uk/for-organisations/uk-gdpr-guidance-and-resources/lawful-basis/a-guide-to-lawful-basis/lawful-basis-for-processing/public-task/"public task and is why we do not need your explicit consent for your information to be used. We are under legal obligation to process your application which contains personal information. Relevant legislation includes the following: - Town and Country Planning (Wales) Act 1990 (as amended) Town and Country Planning (Development Management Procedure) (Wales) Order 2012 (as amended) Planning Act 2008 Planning (Wales) Act 2015 We are legally obliged to make some information publicly available. This is a permanent record of planning decisions that form part of the planning history of a site, along with other facts that form part of the land search. Any comments received as part of the consultation process with a planning application are taken into account in the decision-making process and are summarised in the case Officers Report. This is publicly available on the Councils website. Sometimes it will be necessary to include the address in the response to clarify the concerns of a specific resident and the impact a development may have on that resident. Names will not routinely be included (more info below). How we share your information We do not sell your information to other organisations. We do not use your information for automated decision making. We make details of planning applications we receive available online so that other people can contribute their comments. Please note: We do publish the name of the person applying for planning permission along with the application address We do not publish their signature or contact details such as telephone numbers and email addresses We do not publish comments received on planning applications by members of the public, however they may be referred to in an officers report as outlined above. If requested these comments will be made available publicly but some information will be redacted (more info below) We do not publish comments received on planning applications by town councils / local councillors / amenity groups / consultees. If requested these comments will be made available publicly but some information may be redacted where required. We routinely send planning applications to external consultees and other departments within the Council for their professional advice on related matters e.g. environmental health, landscape, highways. We will sometimes need to share information we have with other parts of the council, for example, to establish how long a building has been used as a dwelling. We may also share your information with other, external organisations including, Planning Environment Decisions Wales (PEDW) (see below for more information), Welsh Government, Your Legal Representatives and Building Control Partner Authorities. Redaction Planning legislation requires Blaenau Gwent Council to make details of applicants and proposals for planning permission available for public inspection. They will be made available to view on the Councils website. We operate a policy where we routinely redact the following details before making forms and documents available online: Personal contact details for the applicant, e.g. telephone numbers, email addresses and signatures Special Category Data e.g. supporting statements that include information about health conditions or ethnic origin Sometimes we might decide it is necessary, justified and lawful to disclose data that appears in the list above. In these circumstances we will let you know of our intention before we publish anything. If you are submitting supporting information which you would like to be treated confidentially or wish to be specifically withheld from the public registers, please let us know immediately. If requested to be viewed by a member of the public, applicant, agent or other third party, the comments will be made available along with the address of the author. It is important to have this information to assess the impact of the development spatially on anyone who has commented. Comments will also be summarised in the Officer Report which is publicly available on the Councils website once a decision has been issued on delegated items or the Planning Committee agenda. Sometimes it will be necessary to include the address in the report to clarify the concerns of a specific resident and the impact a development may have on that resident. Other personal contact details (such as name, email address, telephone numbers, signatures, Special Category Data, etc) will not be published online or provided publicly if requested. The Local Government Act 1985 (Access to Information) requires all background papers (such as any comments received from members of the public) for decisions made at Planning Committee to be publicly available prior to the application being reported to Planning Committee. When an application is reported to Planning Committee, the Authority will be required to make the copies public in line with the information outlined above. Planning Appeals In circumstances where a planning application/enforcement notice is appealed, we are required to share data from a planning application with Planning and Environment Decision Wales (PEDW), which includes any comments made by statutory consultees and members of the public. Applicants, in most circumstances, have a statutory right of appeal to the PEDW. This means that the Council will have to share the details of the case with the PEDW, including personal data and possibly special category data, along with all the representations made about the application. The appeal questionnaire statutorily requires LPAs to provide the PEDW and the appellant with information relevant to their processing of the case. For planning appeals, this includes any interested party representations received at the application stage. As the address of the person making a representation may provide additional context (particularly in respect of overshadowing, privacy or noise arguments), this information should normally be included with the interested party representations that LPAs are required to provide to PEDW and appellant. Retention (how long do we keep your information for) We will retain your information in line with the statutory requirements and will keep your information only for as long as it is needed, after which it will be deleted or destroyed. The Statutory Planning Register is kept in perpetuity Requests for Information All recorded information held by Blaenau Gwent Council may be subject to requests under the Freedom of Information Act 2000, Environmental Information Regulations 2004 and the Data Protection Act.
